1. Acceptance of Terms

By accessing or using VillageAcres ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Platform.

2. Platform Description

VillageAcres is a matching platform that connects families seeking childcare services with independent caregivers. We are solely a matching service and do not employ, supervise, or control any caregivers listed on the Platform.

All caregivers on VillageAcres are independent contractors who operate their own childcare services. Any arrangement made between families and caregivers is a direct agreement between those parties.

3. Assumption of Risk and Limitation of Liability

USE OF THIS PLATFORM IS AT YOUR OWN RISK. By using VillageAcres, you acknowledge and agree that:

  • VillageAcres is a matching platform only and does not provide childcare services directly.
  • You are solely responsible for evaluating and selecting any caregiver for your family.
  • You should conduct your own additional screening, interviews, reference checks, and verification of any caregiver before entrusting them with the care of your children.
  • Background checks, while provided as a service, are not a guarantee of safety or suitability and may not reveal all relevant information.
  • VillageAcres makes no warranties or representations regarding the qualifications, suitability, reliability, or trustworthiness of any caregiver.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VILLAGEACRES AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS DISCLAIM ALL LIABILITY FOR ANY CLAIMS, DAMAGES, LOSSES, OR INJURIES ARISING FROM:

  • Your use of the Platform or any services obtained through it
  • Any interactions or arrangements with caregivers or families
  • Any acts, omissions, or conduct of caregivers or other users
  • The accuracy or completeness of any information provided on the Platform
  • Background check results or the absence of adverse information

4. Your Responsibilities

For Families:

  • Conduct thorough interviews and reference checks with potential caregivers
  • Verify credentials, certifications, and experience independently
  • Consider conducting additional background screening through other services
  • Supervise initial interactions between caregivers and children
  • Establish clear expectations, schedules, and emergency procedures with your caregiver
  • Maintain open communication and address any concerns promptly

For Caregivers:

  • Provide accurate and truthful information in your profile
  • Complete the required Checkr background check
  • Maintain appropriate insurance coverage for your services
  • Comply with all applicable laws and regulations regarding childcare
  • Immediately report any safety concerns to families and, if necessary, authorities

5. Background Checks

All caregivers on VillageAcres are required to complete a Checkr Essential background check (which includes SSN verification, national criminal database search, sex offender registry search covering all 50 states, and global watchlist search) and undergo manual verification by our team. However, you understand and agree that:

  • Background checks may not reveal all relevant criminal history or other information
  • Records may be incomplete, inaccurate, or not yet updated
  • A clear background check does not guarantee future behavior or suitability
  • You should conduct additional screening based on your family's specific needs

6. Best Efforts Service

VillageAcres provides reasonable services on a best-effort basis to help protect our community, including:

  • Requiring Checkr Essential background checks for all caregivers
  • Manual review and verification of caregiver profiles
  • Providing a platform for secure messaging between users
  • Investigating reported concerns about users

However, these measures do not constitute a guarantee or warranty of safety, andVillageAcres assumes no liability for the actions of users.

7. Indemnification

You agree to indemnify and hold harmless VillageAcres, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Platform, your violation of these Terms, or your interactions with other users.

8. Dispute Resolution

Any disputes arising from your use of VillageAcres shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. By using the Platform, you waive your right to participate in class action lawsuits.

9. Modifications to Terms

VillageAcres reserves the right to modify these Terms at any time. Continued use of the Platform after changes are posted constitutes acceptance of the modified Terms.
